Terms of Service

Article 1 (Formation of the Contract)

  • 1. A user of this service (hereinafter "Member") refers to a person who has purchased Cross eSIM (hereinafter the "Service") provided by CrossData Co., Ltd. (hereinafter the "Company") by the prescribed method and whose payment the Company has confirmed.
  • 2. A sales contract is formed between the Member and the Company at the point when the Member completes the purchase procedure for the Service and the Company confirms the payment.
  • 3. The purchase details (such as country/region of use, data volume, and usage period) shall follow the content stated on the order confirmation screen and the confirmation email.
  • 4. The Member shall purchase the Service after agreeing to these Terms.
  • 5. Because the Service is a digital product, once payment is completed, the setup QR code and related information will generally be sent to the registered email address within about 5 minutes.
  • 6. Due to the nature of digital products, cancellations, changes, and refunds after payment are generally not accepted.
  • 7. If a problem occurs with setup or connection, the Member shall promptly contact the Company. If the Company was not given the opportunity to respond, refunds cannot be provided.
  • 8. Only when a communication malfunction is due to reasons attributable to the Company may the Company refund part or all of the amount, up to the purchase price, based on the Company's prescribed calculation method. However, the Company is not responsible for the line quality or communication failures of local carriers.
  • 9. If the Service cannot be used due to the Member's fault (such as changing device settings, accidental deletion, or use of an unsupported device), the Company bears no responsibility and will not provide a refund.

Article 2 (Handling of Personal Information)

The Company uses Members' personal information within the scope of providing the Service, processing payments, providing support, and managing contracts. Details are set out in the Company's Privacy Policy.

Article 3 (Nature of the Service and Disclaimer)

  • 1. The Company guarantees only that the eSIM has ordinary communication functions, and does not guarantee fitness for any particular purpose.
  • 2. Communication speed, communication quality, and signal conditions depend on the local carrier and usage environment, and the Company does not guarantee them.
  • 3. If no malfunction is reported within 48 hours after departure, the Service may be deemed to have been provided normally.

Article 4 (Usage Period)

  • 1. The usage period begins at the point when the Member activates (enables) the eSIM.
  • 2. The usage period shall be the period stated in the purchased plan.
  • 3. After the usage period expires, communication automatically stops. If the Member wishes to extend it, the Member shall purchase an additional plan.

Article 5 (Limit on Sales Quantity)

  • 1. The Company may limit the sales quantity due to carrier line supply conditions, technical constraints, allocation caps per country/region, system maintenance, or other reasonable reasons.
  • 2. The Company is not responsible if a purchase is not completed due to sales limits.

Article 6 (Fees)

  • 1. Fees apply at the amount displayed at the time of purchase.
  • 2. Fees may change due to factors such as exchange rate fluctuations or price revisions.
  • 3. For purchases already settled, the price at the time of that purchase applies.

Article 7 (Payment Methods)

  • 1. Payment methods shall be those designated by the Company, such as credit card, Google Pay, Apple Pay, Amazon Pay, PayPal, and PayPay.
  • 2. The Company is not responsible for payment errors, authentication failures, or similar issues.
  • 3. The same payment conditions apply to additional purchases.

Article 8 (Cancellation)

  • 1. Because the Service is a digital product, no refund is provided after purchase.
  • 2. Provision is deemed complete at the time the eSIM is issued.

Article 9 (Management of the eSIM)

  • 1. The Member manages the QR code and setup information at their own responsibility.
  • 2. Transfer, resale, and redistribution are prohibited.
  • 3. If the eSIM becomes unusable due to deletion, initialization, OS updates, or similar events, reissuance is generally not provided.

Article 10 (Country Restrictions)

  • 1. The eSIM can be used only in the designated countries/regions.
  • 2. The Company is not responsible for damages caused by use in non-covered regions.

Article 11 (Loss/Deletion of the eSIM)

  • 1. An eSIM deleted or lost by the Member cannot be reissued.
  • 2. In the case of a system failure by the Company, reissuance may be provided within a reasonable scope.

Article 12 (Termination of the Contract)

  • 1. If there is a violation of these Terms, fraudulent use, non-payment, or a similar circumstance, the Company may terminate the contract without prior notice.
  • 2. The Company is not responsible for damages arising from termination.

Article 13 (Consultation)

If a matter not stipulated in these Terms arises, or if a question arises regarding the interpretation of these Terms, the Company and the Member shall consult and make every effort to resolve it.

Article 14 (Other Agreements)

If there is a separate agreement between the Company and the Member outside of these Terms, that agreement takes precedence.

Article 15 (Fair Usage Policy)

In order to provide a fair communication environment to all users, the Service shall comply with the Fair Usage Policy (FUP) established by the carrier in the country/region of use. At the carrier's discretion, if a large volume of communication is performed in a short time, or if communication exceeding the scope of ordinary use is confirmed, communication speed restrictions, connection suspension, or temporary usage restrictions may be applied.

Large-volume communication such as video streaming, online gaming, file sharing, cloud backup, and tethering may be subject to restrictions. These restrictions are implemented under the carrier's management, and the Company cannot apply or lift them.

If a speed restriction or usage suspension based on the Fair Usage Policy occurs, the Company bears no responsibility for refunds or damages.

Article 16 (Limitation of Liability)

The Company makes reasonable efforts in providing the Service, but does not guarantee communication quality, communication speed, or connection stability. The Company is not responsible for damages arising from natural disasters, war, riots, legal revisions, carrier equipment failures, international line failures, device malfunctions, software updates, or other causes beyond the Company's control. Only when communication becomes impossible due to the Company's intent or gross negligence will the Company waive a portion of the usage fee, corresponding to the number of unusable days, up to the eSIM purchase amount. The Company bears no responsibility whatsoever for lost profits, loss of business opportunities, data loss, or other indirect damages.

Article 17 (Suspension of Communication)

If the Member has unpaid fees, engages in fraudulent use or fraudulent acquisition, violates these Terms, or if there is a suspension request from a carrier, or if a serious security risk is recognized, the Company will suspend all or part of the Service without prior notice. Even if the Member suffers damages due to such suspension, the Company bears no responsibility.

Article 18 (Jurisdiction)

In the event of a dispute regarding this contract, the Tokyo District Court shall be the exclusive agreed jurisdictional court of first instance. These Terms are governed by and interpreted in accordance with Japanese law.

Article 19 (Changes to the Terms)

These Terms of Service and the service fees may be changed without notice.
